This agreement is entered into between [firmaadi] (“Seller”) and the person or entity [adsoyad] (“Buyer”) purchasing or subscribing to the digital products.
By purchasing or subscribing to the product, the Buyer declares that they have read, understood, and agree to all provisions of this agreement.
Product Description
Product: The Seller offers access to the digital product(s) or digital product archive(s), of which the qualities and content are specified on the product page, as selected and purchased by the Buyer. The purchased product or archive may receive updates if so specified on its product page.
Delivery Policy
Digital Delivery: The product offered for sale is entirely digital, and no physical delivery will be made.
Access Time: Following a successful purchase or subscription initiation, access to your product is generally provided within 1 hour.
Delivery Method: Access to the product is delivered to you through the application assigned to your user account or by other digital means, such as a license key.
License Models and Usage Rights
The Seller offers two types of license models: a one-time purchase and a fixed-term subscription.
A. One-Time Purchase License
Scope of License: The Seller grants the Buyer a limited, non-transferable, non-exclusive, and revocable license for the personal and commercial use of the purchased digital products.
Single User: This license permits use by only the single user who purchased the digital product.
B. Subscription License (Monthly/Yearly)
Scope of License: Upon purchasing a monthly or yearly subscription, the Seller grants the Buyer a limited, non-transferable, non-exclusive, and revocable license to access and use the digital products for the duration of the subscription term. This license is for personal and commercial use.
Fixed-Term Access and Renewal: Monthly or yearly access packages are billed as a one-time payment at the time of purchase and provide access for the specified duration (1 month or 1 year). When the purchased access term expires, the Buyer’s access to the digital products will be terminated. The system does not automatically charge a renewal fee. To continue access, the Buyer must purchase a new access package through the website.
Access on Termination: Upon cancellation or expiration of the subscription, the Buyer’s access to the digital products will be terminated. The Buyer must cease using the digital products and delete all copies in their possession.
Single User: This license permits use by only the single user who subscribed to the product.
General Restrictions (Applicable to All Licenses):
The Buyer may not copy, reproduce, resell, rent, distribute, share, or transfer the digital product or any part of it to any third party.
Modifying the products or creating derivative works is prohibited.
Refund and Cancellation Policy
Trial Opportunity Before Purchase: We value customer satisfaction. Therefore, we offer all potential buyers a 3-day free trial period to evaluate our product before committing to a purchase. This trial period is an opportunity for you to assess the product’s functionality and its suitability for your needs.
No Refunds: Due to the instantly accessible and replicable nature of digital products, all sales are final, and refunds are not possible. This policy applies to all purchase types, including one-time purchases and initial and renewal payments for monthly or yearly subscription plans.
Subscription Cancellation: You may cancel your active subscription at any time. The cancellation will take effect at the end of the current billing period. No refunds or credits will be provided for partial subscription periods. Your access to the service will continue until the end of your current paid term.
License Cancellation for Violation: If the Buyer violates any term of this agreement, the Seller reserves the right to immediately terminate the Buyer’s license without prior notice.
Intellectual Property Rights
All copyrights, trademarks, and other intellectual property rights related to all purchased digital products belong entirely to the Seller. This agreement grants the Buyer only a limited license for use, not a transfer of ownership.
Disclaimer of Warranties
The Seller provides no warranty regarding the fitness for a particular purpose, performance, or functionality of the digital products. The products are provided “as is”. The Seller shall not be liable for any data loss, profit loss, or other direct or indirect damages arising from the use of the digital products.
Privacy
The Seller will process personal data collected from the Buyer only within the framework of the separate “Privacy Policy” document.
Governing Law and Dispute Resolution
This agreement shall be governed and construed in accordance with the laws of the Republic of Turkey. The parties agree to first seek an amicable solution in the event of any dispute. If no agreement can be reached, the Courts and Enforcement Offices of the Republic of Turkey shall have jurisdiction to resolve the dispute.
Changes to the Agreement
The Seller reserves the right to unilaterally change this agreement at any time. The changes will become effective after they are communicated to the Buyer.
